Ticketlify Terms and Conditions

Welcome to Ticketlify. These Terms and Conditions ("Terms") govern your use of our platform, which enables users to buy, sell, and promote event tickets. By accessing or using the Ticketlify website (https://ticketlify.com), you agree to comply with these Terms. If you do not agree with these Terms, please discontinue using the platform.

1. Introduction

By accessing this website, we assume you accept these terms. Do not continue to use Ticketlify if you do not agree with the terms stated here.

2. Definitions

  • 2.1. Ticketlify: Refers to our event management platform that facilitates ticket sales and event promotion.
  • 2.2. User: Any individual who accesses the platform, whether to purchase tickets, promote events, or browse content.
  • 2.3. Organiser: Refers to individuals or organisations that list events and sell tickets via Ticketlify.
  • 2.4. Promoter: An individual or business that promotes events listed on Ticketlify and earns a percentage of sales based on the terms agreed upon with the organiser.

3. Acceptance of Terms

By using or accessing any part of the Ticketlify platform, you confirm that you accept these Terms and agree to abide by them. If you disagree with any part of these Terms, you must not use the platform.

4. Account Creation and Responsibilities

4.1. Account Creation: Users, Organisers, and Promoters must create an account to access certain features of the platform. You must provide accurate, complete, and up-to-date information during registration.

4.2. User Responsibilities: Users are responsible for safeguarding their account login details and for all actions or activities that occur under their account. If you suspect unauthorised use of your account, you must notify Ticketlify immediately.

4.3. Organiser Responsibilities: Organisers must provide accurate and detailed information about their events, including the event location, time, date, and any other pertinent details. Organisers are solely responsible for delivering the events as advertised and for handling any post-purchase issues with ticket buyers. Organisers are liable for any chargebacks or payment disputes arising from their events, as further detailed in Section 10.3.

4.4. Promoter Responsibilities: Promoters must adhere to the terms agreed upon with the organiser when promoting events. Promoters are paid a certain percentage of ticket sales within 72 hours after the event's conclusion, as long as the terms of promotion have been met.

5. Ticket Purchases

5.1. Finality of Sales: All ticket purchases through Ticketlify are final. Once a ticket is purchased, it cannot be canceled, exchanged, or refunded, unless otherwise specified by the event organiser.

5.2. Organiser’s Refund Policy: Refund policies are established by the event organiser and may vary by event. It is the user’s responsibility to review the organiser’s refund policy before making a purchase. Ticketlify is not responsible for refunding tickets, and any disputes regarding refunds should be directed to the organiser.

5.3. Event Changes: In case of event cancellations, postponements, or other significant changes, the event organiser is responsible for communicating with ticket holders. Ticketlify is not liable for any event modifications or losses incurred.

6. Event Listings and Accuracy

6.1. Organiser's Responsibility: The event organiser is responsible for ensuring that all event information, including the date, time, venue, pricing, and any promotion, is accurate and complete. Ticketlify is not responsible for any inaccuracies in event listings or details provided by the organiser.

6.2. User Due Diligence: Users are encouraged to verify event details, such as location and time, before purchasing tickets. Ticketlify is not liable for misstated events or inaccurate information provided by organisers.

6.3. Promoter Accountability: Promoters must ensure that any information they share about the events they are promoting is accurate and aligns with the organiser's details. Any breach in promotion agreements may result in the withholding of commissions.

7. Prohibited Activities

  • Use the platform for illegal purposes, including but not limited to fraudulent transactions, ticket scalping, or promoting counterfeit tickets.
  • Misrepresent events or tickets.
  • Infringe on any intellectual property rights of Ticketlify or other parties.
  • Engage in activities that compromise the security, availability, or operation of the platform.

8. Intellectual Property

8.1. Platform Content: All content, design, logos, trademarks, and features on the Ticketlify platform are the intellectual property of Ticketlify or its licensors. Users are not permitted to copy, modify, distribute, or use any part of the platform without prior written consent.

8.2. User-Generated Content: By submitting content, such as event listings, promotions, reviews, or feedback, users grant Ticketlify a worldwide, non-exclusive, royalty-free license to use, distribute, and display such content in connection with the platform.

8.3. User-Generated Content Policy & Zero-Tolerance: Ticketlify allows users to post, upload, or share content, including comments, posts, discussions, and profile details ("User-Generated Content" or "UGC"). We maintain a strict zero-tolerance policy toward objectionable content and abusive behavior. By using the Ticketlify app or website, you agree not to submit, post, or distribute any User-Generated Content that:

  • Is abusive, threatening, harassing, defamatory, or libelous.
  • Contains hate speech, or targets individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or nationality.
  • Contains sexually explicit, obscene, vulgar, or pornographic material.
  • Promotes violence, illegal acts, or dangerous activities.
  • Infringes upon any intellectual property, privacy, or publicity rights of others.

Reporting and Flagging Objectionable Content

To ensure a safe community, Ticketlify provides built-in mechanisms for users to flag and report violations:

  • Flagging Content: Users can report any User-Generated Content that violates this policy directly within the application.
  • Reporting Users: Users can report or flag other users who engage in abusive behaviors or repeatedly upload objectionable content.
  • Moderation Action: Upon receiving a report, our moderation team will review the flagged content or user behavior within twenty-four (24) hours and take appropriate action.

Blocking Abusive Users

Any user has the right and capability to block abusive users. Blocking a user immediately prevents them from interacting with you, viewing your content, or sending you communications within the app.

Enforcement and Termination (Zero-Tolerance)

Failure to comply with our User-Generated Content guidelines will result in immediate enforcement action. Ticketlify reserves the right, at its sole discretion and without prior notice, to:

  • (1) Immediately remove, delete, or disable access to any objectionable content.
  • (2) Temporarily suspend or permanently terminate the account of any user who violates these terms or engages in abusive behavior.
  • (3) Report illegal activities to appropriate law enforcement authorities.

9. Promoter Compensation

9.1. Secure Transactions: All payments made through Ticketlify are processed via secure third-party payment providers. By using the platform, you agree to the terms and conditions of these payment processes. Ticketlify does not store any payment details.

9.2. Fees: Organisers and promoters may be subject to service fees for listing events, promoting events, and selling tickets on Ticketlify. All fees will be clearly communicated before any transactions are completed.

10. Payment Processing

10.1. Payment Terms: Promoters will receive a specified percentage of ticket sales generated through their promotions. Payment will be made within 72 hours after the event has concluded, provided the terms of the promotion agreement have been met.

10.2. Disputes: In case of any disputes regarding the payment or terms of promotion, the issue must be addressed between the organiser and the promoter. Ticketlify is not responsible for disputes arising from promotion agreements.

10.3. Chargebacks and Payment Disputes: When a ticket buyer initiates a chargeback or payment dispute with their card issuer or payment provider in connection with a ticket purchase made through Ticketlify, the Event Organiser associated with that transaction shall be solely liable for the disputed amount. Ticketlify reserves the right to debit the full disputed amount, including any chargeback fees, processing fees, or administrative costs imposed by our payment processor, directly from the Organiser's pending or future earnings held on the platform.

Organisers acknowledge and agree that:

  • (a) Chargeback Fees: Each chargeback incurs a non-refundable fee (as set by payment processor), which will be passed on in full to the Organiser responsible for the disputed transaction.
  • (b) Deduction from Earnings: Ticketlify is authorised to automatically deduct the disputed transaction amount plus any associated chargeback fees from the Organiser's available balance or future payouts without prior notice.
  • (c) Negative Balance: If the Organiser's balance is insufficient to cover the disputed amount and associated fees, the Organiser is obligated to reimburse Ticketlify for the outstanding amount within 14 days of written notice. Failure to do so may result in account suspension, termination, or legal action to recover the debt.
  • (d) Dispute Resolution: Organisers are responsible for providing Ticketlify with all necessary evidence and documentation to contest a chargeback where applicable. Ticketlify will make reasonable efforts to submit evidence on behalf of the Organiser but does not guarantee the outcome of any dispute resolution process.
  • (e) Fraudulent Chargebacks: Ticketlify reserves the right to immediately suspend or terminate the account of any Organiser whose events generate a pattern of chargebacks or disputes that suggest fraud, misrepresentation, or a failure to deliver advertised events.

11. Platform Usage

Users agree not to use the platform for illegal or unauthorized purposes, including but not limited to fraudulent ticket transactions, event misrepresentation, or violating intellectual property rights.

Ticketlify reserves the right to suspend or terminate accounts for any violation of these Terms and Conditions.

12. Limitation of Liability

Ticketlify is not responsible for the accuracy of event details provided by organizers. Users are encouraged to review event listings before purchasing tickets.

To the extent permitted by law, Ticketlify is not liable for any damages or losses resulting from the use of our platform, including but not limited to loss of data, business interruption, or financial losses.

13. Privacy and Data Protection

By using Ticketlify, you acknowledge and agree to our Privacy Policy, which governs how we collect, use and share your personal data.

14. Changes to Terms and Conditions

Ticketlify may modify these Terms and Conditions at any time. Continued use of the platform after any changes constitutes acceptance of the revised terms.
